Stay Vacated In Cessna Crash Case

Law360, New York (October 24, 2007, 12:00 AM EDT) -- An appeals court has vacated a lower court's stay of a case brought by an American plaintiff whose daughter was killed in a deadly Cessna Aircraft Co. airplane crash in Italy, allowing the claims to proceed in the same district court that imposed the stay.

In a ruling handed down Wednesday in the U.S. Court of Appeals for the Eleventh Circuit, a three-judge panel said that there was “no indication” when, if ever, proceedings in an Italian court will resolve the claims raised in the case...
