High Court Wants SG's View On SOX's Whistleblower Provisions

Law360, New York (October 9, 2012, 3:34 PM EDT) -- The U.S. Supreme Court asked the solicitor general Tuesday to weigh in on two retaliation suits over privately owned Fidelity Investments' alleged violations of the Sarbanes-Oxley Act, hoping to clarify whether private contractors of public companies are covered by the law's whistleblower protections.

The First Circuit ruled in February that employees in the Fidelity suits were not entitled to whistleblower protections because Fidelity was a privately-owned company not liable for retaliation under Section 806 of the law, even though Fidelity worked as a mutual fund manager...
