Enviga Plaintiffs Fight Releasing Work, Health Records

Law360, New York (October 26, 2007, 12:00 AM EDT) -- The plaintiffs in the ongoing lawsuit over Coca Cola Inc.'s “calorie burning” energy drink Enviga have asked to appeal an order by a magistrate judge that would force them to produce their past 10 years of medical and employment records in the consumer fraud action.

The complaint, brought against Coca Cola and Nestle USA Inc., alleged that “there was no evidence showing that most New Jersey consumers would realize any calorie-burning benefit” from Enviga. But the two companies heavily advertised that the drink would cut calories....
