Blue Cross Says Hospital Co. Broke Logo Infringement Deal

Law360, New York (October 12, 2012, 1:46 PM EDT) -- The Blue Cross and Blue Shield Association sued America Universal Health Services Inc. on Thursday, claiming the hospital operator infringed its trademarked blue cross logo, breaching a prior lawsuit's settlement in which UHS agreed not to use the color blue in its cross logos.

The suit, filed in Illinois federal court, claims that UHS' Wellington Regional Medical Center is utilizing a blue cross logo and asserts breach of contract Lanham Act, unfair competition and competition and trademark dilution claims.
