Pfizer Asks 11th Circ. To Block CEO's Chantix MDL Testimony

Law360, New York (October 12, 2012, 3:37 PM EDT) -- Pfizer Inc. on Wednesday asked the Eleventh Circuit to overturn an order compelling its CEO and two other employees to testify in person at a bellwether trial in multidistrict litigation over alleged dangerous side effects of smoking cessation drug Chantix, saying traveling to testify would put an unlawful burden on the employees.

According to Pfizer’s petition for mandamus, U.S. District Judge Inge P. Johnson had erroneously enforced subpoenas requiring the three Pfizer employees — including chairman and CEO Ian Read — to appear at the bellwether...
