Ikon, GE Capital Say NewCal Ruined Records In Antitrust Row

Law360, New York (October 15, 2012, 6:05 PM EDT) -- Ikon Office Solutions Inc. and General Electric Capital Services Inc. urged a California court Friday to sanction business services provider NewCal Industries Inc. for intentionally destroying evidence and keeping them from adequately defending themselves from antitrust claims.

NewCal and other plaintiffs in the seven-year-old antitrust and fraud case over copier lease and service agreements failed to do enough to preserve evidence, and NewCal employees also thwarted Ikon and GE Capital's efforts to defend themselves by intentionally destroying significant amounts of records, the defendants said.
