Appeals Court Rules On Contentious Discovery Issue In International Patent Litigation

Law360, New York (August 11, 2005, 12:00 AM EDT) -- A federal appeals court affirmed Tuesday a decision allowing confidential documents discovered in U.S. patent litigation to be used in related foreign litigation.

Judge Garvin Murtha of the United States Court of Appeals for the 2nd Circuit issued the order. He stipulated the documents in question be released from protective order restrictions and turned over to litigants abroad.

The discovery stems from a patent suit filed by Electronics firm U.S. Philips Corp. against Tokyo-based manufacturer Iwasaki Electric Co.
