NJ Town Sues Insurers For Defense In Pollution Rows

Law360, New York (October 15, 2012, 6:35 PM EDT) -- A northern New Jersey municipality caught up in sprawling litigation over the contamination of the Newark Bay Complex has sued several insurers for allegedly shirking their obligations to fully defend the town against third-party environmental claims.

Seeking cleanup costs and penalties, the New Jersey Department of Environmental Protection sued entities including Maxus Energy Corp. and Tierra Solutions Inc. in 2005 for allegedly polluting the Passaic River with hazardous substances, which contaminated parts of the river, Newark Bay and other waters that make up the Newark Bay...
