9th Circ. Refuses To Rehear RJ Reynolds Camel Cash Case

Law360, New York (October 15, 2012, 5:28 PM EDT) -- The Ninth Circuit on Monday denied R.J. Reynolds Tobacco Co.'s request for an en banc rehearing of its decision reviving breach of contract claims in a class action over the company's decision to stop honoring its “C-Notes” promotional campaign.

RJR had argued the plaintiffs changed their arguments on those claims midway through their appeal, revising arguments as to whether the rewards program constituted a unilateral rather than a bilateral contract. But in a short amendment to the original July opinion, the Ninth Circuit disagreed.
