Franck's, FDA Seek To Drop Compounding Oversight Case

Law360, New York (October 17, 2012, 4:20 PM EDT) -- The U.S. Food and Drug Administration on Tuesday agreed to drop an Eleventh Circuit appeal against Franck's Compounding Lab, a closely watched case dealing with the FDA's authority to regulate animal compounding pharmacies, after Franck's said it was out of the compounding business.

In a joint motion filed Tuesday, the FDA and Franck's Lab Inc. asked the Eleventh Circuit to dismiss the appeal as moot and vacate a lower court's judgment that found that the FDA had no authority to regulate animal compounders. The motion is...
