Pa. Judge To Rethink Delay In Wyeth Fen-Phen Trial

Law360, New York (October 18, 2012, 6:15 PM EDT) -- A Pennsylvania state judge on Wednesday granted Wyeth Pharmaceuticals Inc.'s motion to reconsider staying an upcoming trial in a fen-phen class action while the drugmaker pursues an appeal, which Wyeth argues might be resolved more quickly than previously thought.

Judge Mark Bernstein in the Philadelphia Court of Common Pleas granted Wyeth's motion for reconsideration of the court's refusal last week to stay the trial, set to begin Oct. 22, while Wyeth and other drugmaker defendants have a pending appeal in the Third Circuit.
