2nd Circ. Finds DOMA Unconstitutional

Law360, New York (October 18, 2012, 1:42 PM EDT) -- The Second Circuit on Thursday found the Defense of Marriage Act unconstitutional on equal protection grounds, making it the second federal appeals court to strike down the law defining marriage for federal purposes as between a man and a woman. 

In a 2-1 decision, the Second Circuit ruled in favor of 83-year-old widow Edie Windsor who sued the federal government seeking a declaration that Section 3 of DOMA was unconstitutional after she was hit with $363,000 in federal estate taxes on her wife Thea Spyer's estate....
