Santander USA Unit Hit With Suit Over Illegal Late Fees

Law360, New York (October 18, 2012, 3:48 PM EDT) -- A unit of Spanish global banking giant Santander Group has been accused of assessing late fees to consumers who had not actually fallen behind on their car loan payments, according to a proposed class action removed to Massachusetts federal court Wednesday.

Consumer Cara Powers alleged Santander Consumer USA Inc. wrongfully charged consumers’ credit or debit cards monthly late fees on several occasions when they were not even behind on their car loan payments and engaging in unlawful repossession practices.
