Judge Trims Claims In Suit Over Winn-Dixie Data Breach

Law360, New York (October 18, 2012, 4:52 PM EDT) -- A Florida judge trimmed several counts from a proposed class action brought by a Winn-Dixie Stores Inc. employee alleging the company and an employee purchasing plan failed to adequately protect personal data or timely notify victims of a data breach.

Judge Ursula Ungaro determined that plaintiff Patrick A. Burrows failed to allege sufficient facts to assert claims of negligence, invasion of privacy or violation of the Federal Stored Communications Act in his suit accusing Winn-Dixie of transferring personally identifiable information — including date of birth, salary...
