Rajaratnam Attacks Wiretap, Conviction At 2nd Circ.

Law360, New York (October 25, 2012, 4:07 PM EDT) -- Prosecutors made false statements to win a wiretap of convicted insider trader Raj Rajaratnam, his lawyer told the Second Circuit on Thursday, pushing the appeals court to overturn the guilty verdict and 11-year prison sentence.

Criminal investigators should have told the judge reviewing the application to wiretap Rajaratnam's cellphone that a parallel U.S. Securities and Exchange Commission probe might have produced investigative results, attorney Patricia A. Millett of Akin Gump Strauss Hauer & Feld LLP said at oral arguments before a three-judge panel.
