Genesis Offer To Nurse Didn't Moot FLSA Suit, High Court Told

Law360, New York (October 22, 2012, 6:39 PM EDT) -- The federal government has told the U.S. Supreme Court that Genesis Healthcare Corp.'s offer to resolve a former nurse's meal break claims shouldn't render a putative collective action moot because the nurse never accepted the offer.

In an amicus brief filed Oct. 17, attorneys from the U.S. Department of Labor and the Solicitor General's Office said the high court should uphold a Third Circuit finding that kept alive a proposed Fair Labor Standards Act collective action brought by lead plaintiff Laura Symczyk, a former Genesis nurse....
