Purdue's OxyContin Patent Suit Survives Dismissal Bid

Law360, New York (October 22, 2012, 6:52 PM EDT) -- A New York federal judge refused Friday to throw out a patent suit Purdue Pharma LP brought against KVK-Tech Inc. over plans to market a generic version of  painkiller OxyContin, ruling KVK had worked on the marketing plans.

U.S. District Judge Sidney H. Stein rejected KVK's argument that only a co-defendant, a recently incorporated company called Varam Inc., could be sued for planning to bring the generic OxyContin to market before Purdue's patents expire.
