Law360, New York (October 22, 2012, 4:05 PM EDT) -- The judge presiding over multidistrict litigation alleging a conspiracy to hike mushroom prices overruled objections on Monday from mushroom company M.D. Basciani & Sons Inc. over sanctions, saying a magistrate judge had not erred when issuing sanctions for document destruction.
U.S. District Judge Thomas N. O'Neill Jr. shot down Basciani's argument that Judge Timothy R. Rice's sanctions order related to an affiliate Basciani Foods Inc.'s destruction of documents was contrary to law, saying the magistrate judge had made no error of fact or law.
