Dollar General Managers Lose Class Cert. In OT Suit

Law360, New York (October 23, 2012, 2:42 PM EDT) -- An Alabama federal judge on Monday decertified a class of Dollar General managers who claimed the discount retailer denied them overtime pay, ruling that the workers' duties were too varied for collective status.

U.S. District Judge L. Scott Coogler said that some of the managers performed mostly manual labor — meaning they probably should have received overtime — while others were properly classified as executives, who can be legally exempted from the Fair Labor Standards Act's overtime requirements.
