San Francisco Wants Rehearing On Cellphone Warning Law

Law360, New York (October 23, 2012, 5:52 PM EDT) -- San Francisco officials on Friday pushed for a rehearing before the full Ninth Circuit to allow the city to implement its cellphone radiation warning law, saying a three-judge panel dismissively struck down the suit last month without addressing its critical First Amendment issues.

In a 34-page petition for rehearing en banc, attorneys for the city said the panel was wrong to strike down San Francisco’s ordinance as unconstitutional in a brief two-page unpublished opinion that offered no meaningful guidance on an important public policy issue....
