Grievance Procedures Can Satisfy Due Process, 2nd Circ. Says

Law360, New York (October 24, 2012, 9:40 PM EDT) -- An ex-school system superintendent has immunity from a suit brought by a worker who said her constitutional rights were violated when she lost her job, the Second Circuit ruled Wednesday, saying that post-termination grievance procedures can satisfy due process requirements.

Former Connecticut Technical High School System Superintendent Abigail Hughes' conduct did not violate the clearly established rights of Linda Coollick and is therefore entitled to qualified immunity, a three-judge panel ruled, remanding the case with instructions to enter summary judgment in Hughes' favor.
