Calif. Appeals Court Revives Station Fire Home Damage Suit

Law360, New York (October 25, 2012, 5:38 PM EDT) -- A California appeals court on Wednesday revived a suit brought against a Farmers Group Inc. reciprocal insurer by homeowners whose houses were damaged during the August 2009 California Station Fire, saying the lower court should have applied California’s notice-prejudice rule.

The California Court of Appeals overturned Fire Insurance Exchange’s successful dismissal of a suit brought by Ocie Henderson, Anthony Wallace, and Roscoe and Edna Allen, who claimed they were wrongfully denied property damage coverage following the 2009 wildfire that destroyed 250 square miles and 89 homes...
