Group Urges Pa. High Court To Decertify Wal-Mart Class

Law360, New York (October 26, 2012, 4:43 PM EDT) -- A retail lobbying group on Friday urged the Pennsylvania Supreme Court to reverse the certification of a class of Wal-Mart Stores Inc. workers who claimed they were owed compensation, saying a trial court’s decision infringed the retail giant’s due process rights.

The Retail Litigation Center argues in an amicus brief that the judgment that a trial court awarded 187,000 employees was improperly based on testimony from only six workers who claimed they were not properly compensated for break periods and off-the-clock work.
