Cincinnati Fights Coverage of W.Va. AG's 'Pill Mill' Suit

Law360, New York (October 26, 2012, 6:36 PM EDT) -- Cincinnati Insurance Co. sued drug distributor H.D. Smith Wholesale Drug Co. in Illinois Friday, attempting to avoid covering Smith in a lawsuit alleging it's part of a "pill mill" system contributing to West Virginia's epidemic of painkiller abuse.

Cincinnati says that it owes no duty to defend Smith in the suit — which was brought by West Virginia Attorney General Darrell McGraw against Smith and 13 other out-of-state drug distributors — on the grounds that the West Virginia complaint does not allege an occurrence recognized under...
