3rd Circ. Sinks Honeywell's 1st-Filed Claim In Union Row

Law360, New York (October 29, 2012, 3:35 PM EDT) -- The Third Circuit on Friday found that a district court appropriately deferred to a union's lawsuit in Michigan against Honeywell International Inc. over retiree health benefits when it dismissed a similar lawsuit that the company filed earlier in New Jersey.

Honeywell unsuccessfully argued that the New Jersey federal court erred by not following the "first-filed rule," under which the first of two identical suits in federal court should generally be allowed to move forward.
