Mass. High Court Favors Fannie Mae In Home Seizure Case

Law360, New York (October 29, 2012, 3:14 PM EDT) -- Massachusetts' highest court sided with Fannie Mae on Friday, saying that the mortgage giant's use of a state foreclosure form to give notice to evict homeowners was in line with the law and does not need to include more specific information on the foreclosure.

Affirming a lower court decision, the Massachusetts Supreme Judicial Court ruled that the long-running practice of issuing an affidavit of sale is sufficient to establish a lender's right to possess a property and that it is the burden of a foreclosed homeowner...
