Justices Decline To Weigh $62M Patent Verdict Against Nova

Law360, New York (October 29, 2012, 1:53 PM EDT) -- The U.S. Supreme Court on Monday rejected Nova Chemicals Corp.'s appeal of $62 million patent verdict against it in a case brought by Dow Chemical Inc., refusing to hear Nova's arguments that the Federal Circuit used incorrect legal standards for proving standing and patent indefiniteness.

In its high court petition, filed in August, Nova said that that the Federal Circuit required it to disprove that Dow had standing to bring the case, improperly shifting the burden of proof from the plaintiff to the defendant. The company also asked...
