Fosamax Judge Nixes Bid For Evidentiary Hearing

Law360, New York (November 1, 2007, 12:00 AM EDT) -- The federal judge presiding over the Fosamax litigation has rejected a request by the plaintiffs' steering committee for an evidentiary hearing, claiming to already possess enough material to make an informed decision on the pending motion for class certification.

On Wednesday, U.S. District Judge John Keenan shot down the group's demand for a hearing in the product liability case over the bone cancer drug, ruling that the upcoming oral arguments on this issue will suffice.
