Contractor Loses Bid To Add Claims In Navy Cleanup Suit

Law360, New York (October 31, 2012, 5:33 PM EDT) -- The Federal Circuit ruled Wednesday that an environmental remediation firm had waited too long to bring additional claims over a judgment tied to waste cleanup work it was hired to do at a U.S. Navy facility.

Despite a convoluted procedural history and interplay with a second waste cleanup contract, the Federal Circuit said Wednesday that Environmental Safety Consultants Inc. had waited too long to bring additional claims under the first contract, affirming part of a decision by the U.S. Court of Federal Claims.
