Pa. Court Won't Rehear South Philly Shopping Center Challenge

Law360, Philadelphia (November 2, 2012, 4:30 PM EDT) -- The Pennsylvania Commonwealth Court on Thursday shot down a Philadelphia civic association’s bid for reargument following a September decision affirming the award of a commercial zoning variance for a controversial shopping center proposed along a historically industrial city corridor.

The court rejected a petition for en banc reargument of the case filed in September by the South of South Street Neighborhood Association, a civic association that has opposed plans to turn an abandoned, one-block industrial facility in South Philadelphia into a shopping center.
