Fiberon Beats Claims In Defective Decking Suit

Law360, New York (November 6, 2012, 7:30 PM EST) -- A Pennsylvania federal judge on Friday pared a proposed class action accusing composite decking maker Fiberon LLC of promoting its products as being resistant to rotting when its products are allegedly prone to discoloration from fungus and mold.

U.S. District Judge John R. Padova scrapped the plaintiffs' breach of express warranty claim and state law claims, but preserved other claims including unjust enrichment and violation of state consumer protection acts in Massachusetts, New York and New Jersey.
