Calif. Winemaker Wins Limited Diageo Ban In Trademark Tiff

Law360, New York (November 5, 2012, 3:44 PM EST) -- A Diageo PLC subsidiary will be barred from selling its “Stark Raving” wines in Sonoma County, Calif., after local winemaker Christian Stark convinced a California federal judge Thursday that the larger company's similar brand could confuse his customers.

U.S. District Judge Yvonne Gonzalez Rogers granted Stark’s motion for preliminary injunction, finding that the winemaker’s “Stark Wine” brand had attained sufficient notoriety in Sonoma County that his brand would suffer should Diageo Chateau & Estate Wines Co. continue to sell its “Stark Raving” wines in the area,...
