Wells Fargo Insurance Unit Off Hook For Vacuum Co.'s Defense

Law360, New York (November 7, 2012, 6:08 PM EST) -- A California federal judge on Tuesday dismissed Nor-Cal Products Inc.'s suit against Wells Fargo Insurance Services USA, ruling the insurance broker had no duty to defend the vacuum parts maker in a dispute with an employee.

U.S. District Judge John A. Mendez said Nor-Cal had failed to allege a breach of duty by Wells Fargo. Nor-Cal had pinned its claims on an email sent by Wells Fargo employee Charles Cushner, who allegedly told Nor-Cal that he would help get the company's claim accepted by XL Insurance...
