SEC Must Return Interview Notes In Daisytek Case

Law360, New York (November 5, 2007, 12:00 AM EST) -- A federal judge on Friday ordered the U.S. Securities and Exchange Commission to return certain interview notes and legal memoranda it was planning to use in its case against a former executive at defunct Daisytek International Corp.

In his opinion, Judge Michael H. Schneider of the U.S. District Court for the Eastern District of Texas adopted the findings of Magistrate Judge Don D. Bush, who on Aug. 23 required the SEC to return the documents in question but also refused to dismiss the case.
