National Wildlife Federation Sues NY Over Ballast Water Regs

Law360, New York (November 8, 2012, 2:41 PM EST) -- The National Wildlife Federation on Thursday brought suit in New York state court accusing state environmental officials of failing to adequately protect state waters against aquatic invasive species from vessels’ ballast water discharges in violation of the Clean Water Act.

NWF claims the New York State Department of Environmental Conservation and its commissioner Joseph Martens erred in conditionally approving a vessel general permit proposed by the U.S. Environmental Protection Agency to regulate discharges incidental to the normal operation of commercial vessels, including discharges of ballast water....
