Discover, Firm Lacked Evidence To Pursue Debts, Suit Says

Law360, New York (November 13, 2012, 4:12 PM EST) -- Discover Bank and law firm Weltman Weinberg & Reis LPA were hit with a proposed class action in Pennsylvania federal court Friday that accuses them of trying to collect on credit card debt without proper evidence.

According to the suit, filed by customer Doyle E. Cook Jr., Newcastle, Del.-based Discover, its subsidiary DB Servicing Inc. and Cleveland-based WWR, which serves as a debt collector for Discover, have engaged in an “illegal and deceptive” scheme to collect credit card debt from customers, using false information to back...
