6th Circ. Revives EEOC Sex Bias Case Against Cintas

Law360, New York (November 9, 2012, 9:02 PM EST) -- The Sixth Circuit on Friday reinstated a consolidated racial and sexual discrimination suit against Cintas Corp., finding the U.S. Equal Employment Opportunity Commission did not fail to exhaust its administrative remedies before filing the complaint.

The appeals court said U.S. District Judge Sean Cox had erred in finding that before filing the suit the EEOC did not investigate or seek to conciliate on a class-wide basis claims that Cintas engaged in an “intentional and systemic” pattern of hiring discrimination against women.
