ADEA Doesn't Cover 'Bad' Hiring Picks, 5th Circ. Rules

Law360, New York (November 14, 2012, 3:36 PM EST) -- The Fifth Circuit ruled Tuesday in a decision that individuals who file lawsuits under the Age Discrimination in Employment Act must show an employer made a discriminatory hiring decision, not just a bad one.

The three judge panel declined to reopen an employment suit filed by Albert Cramer — a former 7-Eleven technical manager who claimed he was passed over for a promotion because of his age, saying Cramer failed to show age influenced the promotion and upholding a Texas district court ruling dismissing the suit....
