CB&I Ruling Deters CERCLA Cleanups, US Tells 3rd Circ.

Law360, New York (November 14, 2012, 4:48 PM EST) -- The U.S. government urged the Third Circuit on Tuesday to overturn a district court ruling allowing Chicago Bridge & Iron Co. to dodge environmental cleanup claims, arguing that the decision unfairly punishes Trinity Industries Inc. for entering into a consent decree with state environmental regulators.

Engineering and construction firm CB&I escaped contribution claims under the Comprehensive Environmental Response, Compensation and Liability Act when U.S. District Judge Gary L. Lancaster found that railcar- and barge-maker Trinity did not have legal standing to sue CB&I for cost recovery....
