Eisai Sues Dr. Reddy's Over Aciphex ANDA

Law360, New York (November 20, 2003, 12:00 AM EST) -- The U.S. subsidiary of Japanese drugmaker Eisai has sued Indian generics maker Dr. Reddy's in the U.S. District Court for the Southern District of New York for patent infringement, after the Dr. Reddy's filed an Abbreviated New Drug Application (ANDA) with the U.S. Food and Drug Administration (FDA) for its generic version of ulcer medicine Aciphex.

In a statement, Eisai said it believes that its rabeprazole composition of matter patent is valid until its expiration date of May 8, 2013.
