Gourmet Grocer Demands Continental Cover Burn Claims

Law360, New York (November 19, 2012, 8:29 PM EST) -- The Fresh Market Inc. sued Continental Casualty Co. in South Carolina federal court Monday, claiming the insurer refused to protect the grocery chain after four customers claimed they were severely burned by firepots and fuel made by now-bankrupt Napa Home & Garden.

The Fresh Market is asking the court to find Continental Casualty Company in breach of contract for not honoring the umbrella policy it was under contract to provide — and to force it to cover the burn claims that have spawned numerous suits....
