DOD, Tricare Claim No Harm, No Foul In Data Theft Case

Law360, New York (November 20, 2012, 5:31 PM EST) -- The U.S. Department of Defense and Tricare Management on Thursday urged a Washington judge to toss multidistrict litigation over a data breach that affected 4.9 million Tricare beneficiaries, claiming the plaintiffs suffered no actual injury from the breach.

The DOD and Tricare claim that because the plaintiffs have not alleged facts to show that the theft of computer tapes containing sensitive information from a Science Applications International Corp. employee's car in Sept. 2011 resulted in the actual disclosure of any of those records, they lack standing...
