Fed. Circ. Overstepped In Facebook IP Row, Leader Tech Says

Law360, New York (November 21, 2012, 7:23 PM EST) -- The Federal Circuit lost sight of its proper role as an appeals court and violated Leader Technologies Inc.'s due process rights when it concluded in May that a patent allegedly infringed by Facebook Inc. was invalid, Leader said in a petition for U.S. Supreme Court review.

The Federal Circuit straying beyond the boundaries of its appellate role and engaging in its own fact-finding and advocacy in the Leader case was no isolated incident, but something that occurs with alarming frequency, according to the Nov. 14 petition....
