Banana Farmers To Get Punitive Damages From Dole

Law360, New York (November 8, 2007, 12:00 AM EST) -- Dole Food Co. will have to pay punitive damages on top of the $3.3 million in actual damages awarded to six Nicaraguan banana farm workers who alleged that the company concealed the health dangers of a pesticide used on its banana plantations, a California jury decided on Wednesday.

After the jurors handed down their decision, Judge Victoria Chaney of the Los Angeles Superior Court told them to return Nov. 14 to begin hearing arguments about punitive damages against Dole. In California, punitive damages can soar up...
