General Mills Says 'All Natural' False Ad Suit Lacks Merit

Law360, New York (November 27, 2012, 2:28 PM EST) -- General Mills Inc. urged a Minnesota federal judge Monday to toss a putative class action accusing the company of deceptively advertising its Nature Valley products as "all natural," arguing that such marketing doesn't qualify as a warranty and that the allegedly nonnatural ingredients are listed on the packaging.

Named plaintiffs Tracie Chin and Salvatore Montalbano cannot establish any breach of warranty or fraudulent misrepresentation because they can't show that any actionable warranty exists under federal law, and they never explain when they bought the product or...
