Patriot Coal Ch. 11 Case Moved From NY To Mo.

Law360, New York (November 27, 2012, 7:13 PM EST) -- A New York bankruptcy judge on Tuesday transferred Patriot Coal Corp.'s Chapter 11 proceedings to Missouri, where the debtor's headquarters are located, after union workers urged the judge to move the case out of Manhattan.

U.S. Bankruptcy Judge Shelley C. Chapman held that Patriot's incorporation of PCX Enterprises Inc. and Patriot Beaver Dam Holdings LLC in New York shortly before its bankruptcy filing, while technically complying with the federal Bankruptcy Code, did not fall in line with that the relevant statute on venue selection intended....
