Ex-Employee Sues Shipper CMA Over Background Checks

Law360, New York (November 28, 2012, 12:03 PM EST) -- Container shipping giant CMA CGM (America) LLC was hit Tuesday with a proposed class action in Virginia federal court alleging the company uses consumer reports to make employment decisions without disclosing the reports to prospective and existing employees.

Named plaintiff Carolyn Witt accuses the company of using the background checks to make adverse employment decisions for prospective and existing employees without giving them a chance to respond, in violation of the Fair Credit Reporting Act.
