9th Circ. Greenlights $272M Alaska Rail Extension Project

Law360, Los Angeles (November 28, 2012, 7:59 PM EST) -- A Ninth Circuit panel on Wednesday lifted its stay on a $272 million railway extension project in Alaska, ruling the U.S. Surface Transportation Board followed environmental laws in approving the taxpayer-funded project and that more delays would burden the public.

The order reversed the Ninth Circuit’s 2-1 decision last month to grant a stay on the construction of the 32-mile project by Alaska Railroad Corp. while it reviewed the Surface Transportation Board’s approval of the project.
