UK Court Won't Revive Cartel Claims Against Mersen

Law360, New York (November 29, 2012, 4:01 PM EST) -- A U.K. appeals court refused Wednesday to revive private damages claims against Mersen UK Portslade Ltd. over its alleged role in a graphite cartel, noting that Mersen wasn't specifically targeted when the European Commission fined alleged cartel members €101 million in 2003.

The U.K.'s Competition Appeal Tribunal, which can only hear claims for damages stemming from a decision from either a U.K. or European Union antitrust watchdog, said in 2011 that Emerson Electric Co., Valeo SA and Robert Bosch GmbH had no grounds for their claims...
