Texas Court Upholds TRO In Sierra Club Toxic Dump Battle

Law360, New York (November 29, 2012, 5:23 PM EST) -- A Texas appeals court on Wednesday affirmed a temporary restraining order preventing the Sierra Club from seeking a prohibition on low-level radioactive waste shipments to a disposal facility in Andrews County.

The appeals court rejected the Sierra Club's writ of mandamus petition to withdraw the temporary restraining order. Reversal was unnecessary, the court said, because the TRO obtained by Andrews County expired in July, rendering most of Sierra Club's claims moot.
